Who protects the employer from sexual-harassment claims?
The new requirement for sexual-harassment training for all employees is intended to inform everyone of the new parameters and boundaries, including bullying and sexual orientation. The list of behaviors that now constitute harassment is a long one, greatly expanded in the #MeToo era.
An important question to ask before a company determines who will provide the training, is what is the goal? The majority of trainings that I have witnessed place all the emphasis on what can’t be done. Or what? If workers are told that a simple touch on the arm, intended to make a connection, may constitute harassment, we have entered a dangerous world where virtually anything can be construed to be harassment. The seeds of potential harassment that occurred months or even years before are planted for behavior that may have been innocent and innocuous and truly does not qualify as harassment.
Employers are more vulnerable than ever when something as simple as a brief hug between friends can be considered harassment because it makes someone else feel uncomfortable. It’s an unfair standard that leaves the employer defenseless when the training emphasizes that virtually any physical contact could be harassment in the eyes of an observer. Yet many pieces of training do exactly that; a laundry list of “ don’t do this or it may be considered sexual harassment.”
Who protects the employer?
Our training is different, because we emphasize that not everything is harassment. We demonstrate that a handshake, or a compliment, or a brief hug between friends should not be considered harassment. We explain that intent should be considered, And we explain that every person has the power to inform someone if they are made to feel uncomfortable. We answer lots of questions in our trainings, helping attendees understand and clarify what could be -and what is not- harassment. We use case studies so that attendees can come to a consensus on what constitutes harassment, and what actions to take if they have a question.
