Is your business operating with more than 5 employees?

Is your business headquartered in San Diego, California?

There are many forms of harassment that can occur on the job, but sexual harassment is the most commonly filed complaint. Many employees and business owners may ask, what exactly is categorically considered sexual harassment? The US Equal Employment Opportunity Commission (EEOC) defines it as the following:

The unwelcome sexual advances or requests for sexual favor and other verbal or physical conduct of a sexual nature when said behavior:

  • Implicitly or explicitly impacts an individual’s employment scenario
  • Unreasonably interferes with an individual’s work performance
  • Creates an intimidating, hostile, or offensive work environment

New legislation has been passed in the state of California that dictates that any company with 5 or more employees must incorporate sexual harassment training for every individual on payroll by December 31st, 2020. The laws referenced in this article are AB 1825, AB 2053, SB 396, SB 1300 and SB 1343.

Who Protects Employers From Sexual Harassment Claims?

Towards the end of 2019, California laws were expanded to include sexual harassment training for employees at all levels of corporate structures. As a result, both entry level workers and the highest level leadership positions all require sexual harassment training. The new curriculum introduced is designed to educate employees and managers about newly updated guidelines, boundaries, and parameters that fall under the category of sexual harassment. The new laws are intended to minimize instances of sexual harassment in every workplace. One of the biggest overarching changes in requirement is the inclusion of managerial leadership roles to take 2 extra hours of training more than the baseline standard. The new training must be performed within six months of a promotion and then must occur every two years after the first training.

Liability has also changed under the new statutes and a company’s legal responsibility when it comes to sexual harassment lawsuits has increased. As a result there’s an even bigger emphasison sexual harassment training as a requirement for both state regulation and corporate protection against lawsuits. If you want to take proactive action in educating your employees and protecting against potential legal consequences, contact Bridge Safety Consultants or schedule one of our classes through our web portal. Richard's training was once again fantastic! He really does an excellent job of keeping the group engaged throughout the training. I'm always amazed at how many compliments I get on the training after. In fact, our CEO joined the first training on Tuesday 9/15 just to compliment Richard on his presentation and how much he got out of it last year. Thank you again!

I have received many compliments about the sexual harassment training. The trainers were very entertaining and the employees appreciated that they provided the training in both English and Spanish. Your live training was a lot more enjoyable than virtual training.
